    Terms of Use

An internet store, located at http://shop.psiloc.com, hereafter called “The Store”, is run by:

Psiloc Sp. z o.o. with its headquarters in Warszawa at 3 Robotnicza St., Warszawa 02-261, registered in Regional Court for the City of Warszawa in Warszawa, XIII-th Economy Department of Polish Court Register under KRS 0000262134, with the capital of 3 503 500,00 zł, and NIP 5222820479 [“Service Provider”]


Part I. General provisions

These terms and conditions of electronic service provision [“Terms and Conditions”] were issued pursuant to the Act concerning electronic service provision of July 18th, 2002. (Journal of Laws no. 144, item 1204) [“Electronic Service Provision Act"].

  1. All orders in the Store are completed pursuant to the provisions of these Terms and Conditions.

  2. Placing an order means full acceptance of Terms and Conditions, without the need for a separate agreement.

  3. Terms and Conditions determine the scope and conditions of electronic provision of services and sending of commercial information by Service Provider.

Part II. Conditions of order completion

  1. Service Provider provides, via the Store, services consisting of granting licenses for mobile applications, that they produce.

  2. Orders for products offered by The Store can be placed at any time, 7 days a week, via the Store's website.

  3. All prices given on this website are gross prices (VAT included). The price given for the application at the moment of placing an order by a Customer is binding for both parties.

  4. The Store reserves the right to change the prices for their products, to introduce new and remove old products from the Store, to launch and call off promotional events on Store's website or make changes to such events.

  5. All payments are realised by e-card or paypal systems.

  6. The Store does not collect any information concerning Customers’ credit card numbers for on-line payments. On-line payments are executed through e-card company or paypal.

  7. The Store does not bear any responsibility for faulty operation of e-card or paypal services. Any complaints by the Customers concerning e-card’s or paypal’s operations should be submitted directly to e-card or paypal administrators.

  8. On Customer’s request, a VAT invoice can be issued within 7 days of order completion.

  9. The contract has been concluded in Poland, Warsaw.

  10. Any software available in the Store is licensed, not sold. License conditions, rights and obligations of licensee, as well as any provisions concerning guarantees are included in the license agreement. The license agreement is available on a different page.

  11. License is purchased by receiving a license key. The Customer downloads the setup application, as well as any further updates, from the Internet, by themselves. The license is granted for specific mobile device.

  12. In order to purchase a license, the Customer:
    1. a)specifies the application, for which they wish to purchase such license,
      b)gives the following: name and surname/company name and e-mail address and, if needed, any data required for issuing an invoice.

  13. The license key is automatically sent to the e-mail address given by the Customer as soon as the payment is confirmed. The key can only be sent, if all data given by the Customer are correct.

  14. The applications are offered on “try before you buy" basis. The Customers are advised to download a fully functional trial version of given application (excluding themes, that do not have a trial version), install it and learn about its functionality during the trial period of 10 days. This time should be sufficient to check application’s functions and usefulness. To use the application after this period, a license has to be purchased.

  15. By purchasing the Software, the Consumer agrees to commence service provision before the term of withdrawal from the agreement, as mentioned in art. 7, sec. 1 of an act of March 2, 2000 concerning protection of certain customer rights and concerning responsibility for damage caused by dangerous products (Journal of Laws no. 22, item 271, as amended). According to the above, the consumer does not have the right to withdraw from the agreement, pursuant to art. 10, sec. 3, item 1 of the act cited above.

  16. Service Provider provides an e-mail address for inquiries concerning licensed application. Service Provider also provides a form for submitting any errors in applications.

  17. Answers are given within 2 working days from query receipt by the Provider.

  18. The guarantee does not include any parties, who are not consumers.

  19. Service Provider is obliged to receive consent before sending any commercial or marketing information to the e-mail address given by the Customer.

  20. The e-mail address will only be used for sending requested information. Service Provider shall not send illegal information, pursuant to art. 8.1 sec. 3b of the Electronic Service Provision Act.

  21. Service Provider shall not be held liable for any interruptions in services caused by failures or faulty operation of IT systems beyond Service Provider’s control.

  22. Technical Requirements for using the on-line Store: Internet access, computer or phone with web browser, for license code – e-mail account, Customer's computer has to accept cookies.

  23. In all issues not covered by this Terms and Conditions, the regulations of the Civil Code, the Electronic Service Provision Act and the Act on protection of certain consumer rights and damage caused by dangerous products shall apply.

  24. The Store reserves the right to amend this Terms and Conditions document.
